[MissoulaGov] Dave's proposal is to make it a criminal offense to refuse the test punishable with a $300 fine

Ethel, I hope you didn't take my comments the wrong way. Unfortunately, like
many in our community I've had a loved one effected by the irresponsible
choices of a drunk driver. The guy who hit my friend put all his assets in
his wife's name, leaving my friend with nothing but a limp he'll have for
the rest of his life.
I agree that something needs to be done, but I think that if 6 months
without a car doesn't deter these people, than $300 won't either. Instead
of creating a regulation that may or may not convict a couple extra people,
let's go back to the drawing board and come up with something that actually
has a chance to solve the problem!

The $300 might convince some to take the test = get a conviction = get them
some help and/or jail time to get them off the road and hopefully into a
program.

I agree -- losing the license should be a worse punishment -- except that it
appears that not having a license doesn't keep our repeat offenders off the
road.

Just a quick question..
With regards to Dave's proposal, I'm trying to remember back to my days in
Driver's Education. I recall being told that as a condition of having a
license I'm give consent to be tested for intoxication if required. If I
refuse, than I forfeit the right to have a license for 6 months. Is that
correct?
If so, I think the $300 is by far a lesser punishment than having to get by
without a license for 6 months! Just a little food for thought.
