Even though I was not homeless nor panhandling (aggressive or
otherwise), I have in the years past been known to take a nap in public
places, such as the Oval or Caras park on a sunny day. As I am older, I
am even more prone to taking naps. I think the prohibition is a bit
broad.
Also, I assume it only applies if you don't use furniture, since street
furniture is allowed by ordinance.

The solicitation ordinance is less problematic than the interference
ordinance.
I think we need to be careful about what behaviors we outlaw. I'm not
going to support an ordinance that outlaws sleeping in public places.
There are homeless people in our society. People have to sleep. Therefor
outlawing sleeping in public places is outlawing homelessnes. That's not
going to work.

Yikes! That's a bit harsh. Missoula is by far the most caring community

know of. In fact, I have stated for many years that is one of the reason
I
live here. We should be very careful about how we classify the homeless.
Many homeless people need and want help and Missoulians are more than
willing to provide that help. A few however are incorrigible and create
many
problems for businesses and homeowners throughout the community. These
problems are a result of many deeper social issues and how we as a
society
deal with them. The solicitation ordinance limits but does not prohibit
folks from that activity and as a community we do provide places for the
homeless that need help to go.

Thanks Gary, that is correct. Seth, this would include the boulevard.
But I think you would be OK since the intent of the ordinance is to keep
those with homes from having to see or achnowledge the homeless.

Bob, the way I read the proposed ordinance, Section 3, 9.34.40 A., on
any street, sidewalk, or other public place with the city limits. That
expands the area of prohibition to maybe even parks.

It would only apply to the right of way, which generally goes to the
outside edge of the sidewalk.
