New Timetable: Part C IDEA 2004 Federal Regulations NPRM Expected to be
Published this May
 
According to The Office of Special Education Programs (OSEP) staff, the
draft of Part C of the Individuals with Disabilities Education Improvement
Act of 2004 (Part C) federal regulations has been approved for publication
by the Office of Management and Budget (OMB). The draft regulations had been
under review at OMB since mid January of this year.
 
It is expected that the Notice of Proposed Rulemaking (NPRM) will be
published in the Federal Register (http://www.gpoaccess.gov/fr/index.html)
sometime in the next few weeks. Sometimes the Office of Special Education
and Rehabilitative Services (OSERS) makes unofficial copies of the package
available on the OSERS website
(www.ed.gov/about/offices/list/osers/osep/index.html) before the official
publication date. It is not clear if this will occur for the Part C NPRM.
 
Once the NPRM is published in the Federal Register, there will be a 75
calendar day public comment period and public hearings across the country.
It is expected the hearings will occur in early to mid June. Possible cities
under consideration by OSERS are Washington DC, Atlanta, Kansas City and San
Francisco.
